Terms of Service

Welcome to WashPass (the "App"), a mobile application operated by Ian Joseph Campbell LLC d/b/a Lilac Car Wash ("Lilac Car Wash," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the App and the services provided through it (collectively, the "Services").

By creating an account, checking the "I agree to the Terms of Service" checkbox (or similar affirmation) during registration, or otherwise accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms in the App or on our website at https://lilaccarwash.com. Your continued use of the Services after any changes constitutes your acceptance of the revised Terms.

These Terms incorporate our Privacy Policy, which describes how we collect, use, and share your information.

1. Eligibility

To use the Services, you must:

  • Be at least 18 years old
  • Be a resident of the United States
  • Have the legal capacity to enter into a binding contract

If you do not meet these requirements, you may not use the Services.

2. Account Registration

To access most features of the App, you must create an account by providing accurate and complete information, including your name, email address, phone number, and a password.

We use third-party Google Firebase Authentication to handle account creation, authentication, and verification. WashPass does not possess or store your password; all password management and account verification (including email and SMS verification codes) are securely handled by Google Firebase.

As part of the registration process, we will send a verification code via SMS to your provided phone number and/or via email to your provided email address to confirm your identity. By providing your phone number and email address, you consent to receive these verification messages (message and data rates may apply) as well as other account-related communications via SMS and email.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate your account if any information provided is inaccurate, false, or incomplete.

Accounts are personal, non-transferable, and intended for use by a single individual.

3. Wallet & Suds Loyalty Program

The App features a prepaid digital wallet ("Wallet") and a loyalty program called "Suds."

  • You may add funds to your Wallet in fixed packages ($50, $80, or $100) using a payment method processed through Stripe.
  • Each Wallet reload earns bonus Suds points (1,000–3,000 Suds depending on the package).
  • Wallet funds and Suds may be used to purchase car washes (Basic $13, Ultra $17, Extreme $22) or upgrades.
  • All Wallet funds and Suds are non-refundable and non-transferable. They have no cash value and cannot be redeemed for cash.
  • Wallet funds and Suds do not expire.
  • We reserve the right to modify Suds earning rates, redemption values, or program rules at any time.

4. Purchases & Payments

All payments are processed securely through Stripe. We do not store your full payment card details; Stripe handles all card data in compliance with PCI standards.

Pricing for washes, Wallet packages, and upgrades is subject to change at our discretion. Any changes will be reflected in the App before you complete a purchase.

All purchases are final. No refunds will be issued for Wallet funds, Suds, or completed transactions.

5. QR Code Redemption

To redeem a car wash:

  • Select a wash type in the App and generate a time-limited QR code (valid for 60 seconds only).
  • Present the QR code to the kiosk scanner at one of our automated car wash locations.
  • Each QR code is single-use and tied to your account.

QR codes are non-transferable and may not be shared or sold. Successful redemption activates the car wash bay. We are not responsible for failed redemptions due to expired QR codes, poor scanning conditions, or user error.

6. Location Services

The App includes a Locations feature that uses your device's GPS (with your permission) to display nearby Lilac Car Wash sites and calculate distances. Location access is optional but improves the user experience.

You may grant or revoke location permission at any time in your device settings. We only collect location data when you actively use the Locations page and have granted permission. For details on how we handle location data, please review our Privacy Policy.

7. Prohibited Conduct

You agree not to:

  • Use the Services for any unlawful purpose or in violation of these Terms
  • Engage in fraud, including creating multiple accounts, sharing QR codes, or attempting unauthorized redemptions
  • Attempt to reverse engineer, decompile, or interfere with the App or kiosks
  • Share, sell, or transfer your account, Wallet balance, or Suds
  • Use automated means to access the Services without our permission
  • Harass, threaten, or impersonate others

We reserve the right to investigate and take appropriate action for violations, including account termination and reporting to authorities.

8. Intellectual Property

The App, its content, and all related trademarks are owned by Ian Joseph Campbell LLC d/b/a Lilac Car Wash or its licensors. You are granted a limited, non-transferable license to use the App for personal, non-commercial purposes. You may not copy, modify, distribute, or create derivative works from the App.

9. Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that:

  • The App or kiosks will be uninterrupted or error-free
  • Car wash results will meet your expectations (results may vary due to weather, vehicle condition, or equipment)
  • Kiosks will always be operational (maintenance or technical issues may cause downtime)

10. Limitation of Liability

To the fullest extent permitted by law, Ian Joseph Campbell LLC d/b/a Lilac Car Wash and its affiliates, officers, and employees will not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Services.

Our total liability to you for any claim will not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Ian Joseph Campbell LLC d/b/a Lilac Car Wash and its affiliates from any claims, losses, or damages (including attorney fees) arising from your use of the Services, violation of these Terms, or infringement of third-party rights.

12. Termination

We may suspend or terminate your account and access to the Services at any time, for any reason, including suspected fraud or abuse. Upon termination, any remaining Wallet balance and Suds will be forfeited.

You may delete your account through the App settings, but any remaining balance will also be forfeited.

13. Dispute Resolution

These Terms are governed by the laws of the State of New Hampshire, without regard to conflict of laws principles.

Any dispute arising from these Terms or the Services shall be resolved exclusively in the state or federal courts located in Strafford County, New Hampshire. You agree to submit to the personal jurisdiction of these courts.

To the extent permitted by law, you waive the right to participate in a class action or jury trial.

14. Modifications to Terms

We may update these Terms from time to time. We will notify you of changes by posting the new Terms in the App and updating the "Last Updated" date. Material changes will be highlighted in-app. Your continued use after changes take effect constitutes acceptance.

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Ian Joseph Campbell LLC d/b/a Lilac Car Wash regarding the Services and supersede any prior agreements.
